  • 第一章 总 则
    Chapter I General Provisions
  • 第一条 为了规范排污许可管理,根据《中华人民共和国环境保护法》《中华人民共和国海洋环境保护法》和大气、水、固体废物、土壤、噪声等专项污染防治法律,以及《排污许可管理条例》(以下简称《条例》),制定本办法。
    Article 1 In order to standardize the management of sewage discharge permits, these measures are formulated in accordance with the Law of the People's Republic of China on Environmental Protection, the Law of the People's Republic of China on Marine Environmental Protection, and the laws on the prevention and control of special pollution of the atmosphere, water, solid wastes, soils, noise, etc., as well as the Regulations on Administration of Sewage Discharge Permits (hereinafter referred to as “the Regulations”).
  • 第二条排污许可证的申请、审批、执行以及与排污许可相关的监督管理等行为,适用本办法。
    Article 2 These Measures are applied to the application, approval and implementation and supervision related to pollutant discharge permits.
  • 第三条 依照法律规定实行排污许可管理的企业事业单位和其他生产经营者(以下简称排污单位),应当依法申请取得排污许可证,并按照排污许可证的规定排放污染物;未取得排污许可证的,不得排放污染物。

  • 第五条 国务院生态环境主管部门负责全国排污许可的统一监督管理。

  • 省级生态环境主管部门和设区的市级生态环境主管部门负责本行政区域排污许可的监督管理。

  • 第六条 生态环境主管部门对排污单位的大气污染物、水污染物、工业固体废物、工业噪声等污染物排放行为实行综合许可管理。

  • 排污许可证的申请、受理、审查、审批决定、变更、延续、注销、撤销、信息公开等应当通过全国排污许可证管理信息平台办理。排污单位申请取得排污许可证的,也可以通过信函等方式提交书面申请。

  • 全国排污许可证管理信息平台中记录的排污许可证相关电子信息与排污许可证正本、副本记载的信息依法具有同等效力。
    The electronic information related to the sewage discharge permit recorded in the National Sewage Discharge Permit Management Information Platform and the information recorded in the original and copy of the sewage discharge permit shall have the same effect in accordance with the law.
  • 第九条 排污许可证执行报告中报告的污染物实际排放量,可以作为开展年度生态环境统计、重点污染物排放总量考核、污染源排放清单编制等工作的依据。

  • 第二章 排污许可证和排污登记表内容
    Chapter II Contents of Pollutant Discharge Permit and Pollutant Discharge Registration Form
  • 第十条 排污许可证由正本和副本构成。
    The pollutant discharge permit shall serve as a confirmation certificate for pollutant discharge rights and a management carrier for pollutant discharge trading.
  • 设区的市级以上地方人民政府生态环境主管部门可以依据地方性法规,增加需要在排污许可证中记载的内容。
    The ecological and environmental authorities of local people's governments at or above the level of cities divided into districts may, in accordance with local regulations, add content that needs to be recorded in the pollutant discharge permit.
  • 第十一条 排污许可证正本应当记载《条例》第十三条第一、二项规定的基本信息,排污许可证副本应当记载《条例》第十三条规定的所有信息。

  • 法律法规规定的排污单位应当遵守的大气污染物、水污染物、工业固体废物、工业噪声等控制污染物排放的要求,重污染天气等特殊时段禁止或者限制污染物排放的要求,以及土壤污染重点监管单位的控制有毒有害物质排放、土壤污染隐患排查、自行监测等要求,应当在排污许可证副本中记载。
    Laws and regulations of the sewage unit shall comply with the requirements of air pollutants, water pollutants, industrial solid waste, industrial noise and other control of pollutant emissions, heavily polluted weather and other special times to prohibit or limit the emission of pollutants, as well as soil pollution key regulatory units to control the emission of toxic and hazardous substances, soil contamination, soil contamination, self-monitoring, etc., should be documented in a copy of the sewage discharge permit.
  • 第十二条 排污单位承诺执行更加严格的排放限值的,应当在排污许可证副本中记载。

  • 第十三条 排污登记表应当记载下列信息:

    (a) the name of the sewage registration unit, unified social credit code, the location of the production and business premises, industry categories, legal representatives or the actual person in charge and other basic information.
  • (二)污染物排放去向、执行的污染物排放标准及采取的污染防治措施等。
    (2) The direction of pollutant discharge, the pollutant discharge standards implemented, and the pollution prevention and control measures adopted.
  • 第三章 申请与审批
    Chapter III Application and Approval
  • 第十四条 排污单位应当在实际排污行为发生之前,向其生产经营场所所在地设区的市级以上地方人民政府生态环境主管部门(以下简称审批部门)申请取得排污许可证。

  • 第十五条 排污单位有两个以上生产经营场所排放污染物的,应当分别向生产经营场所所在地的审批部门申请取得排污许可证。
    Article 15: If a pollutant discharging unit has two or more production and operation sites that discharge pollutants, it shall separately apply for pollutant discharge permits from the approving authorities of the locations where the production and operation sites are located.
  • 第十六条 实行排污许可重点管理的排污单位在提交排污许可证首次申请或者重新申请材料前,应当通过全国排污许可证管理信息平台向社会公开基本信息和拟申请许可事项,并提交说明材料。公开时间不得少于五个工作日。

  • 第十七条 排污单位在填报排污许可证申请表时,应当承诺排污许可证申请材料的完整性、真实性和合法性,承诺按照排污许可证的规定排放污染物,落实排污许可证规定的环境管理要求,并由法定代表人或者主要负责人签字或者盖章。
    Article XVII of sewage disposal units in filling out the application form for a sewage discharge permit, shall commit to the completeness, authenticity and legality of the application materials for a sewage discharge permit, a commitment to discharge pollutants in accordance with the provisions of the sewage discharge permit, the implementation of sewage discharge permits stipulated in the environmental management requirements, and by the legal representative or the main person in charge of signing or sealing.
  • 第十八条 排污单位应当依照《条例》第七条、第八条规定提交相应材料,并可以对申请材料进行补充说明,一并提交审批部门。
    Article 18: Pollutant discharging units shall submit corresponding materials in accordance with the provisions of Articles 7 and 8 of the Regulations, and may provide supplementary explanations to the application materials, which shall be submitted to the approving authorities together.
  • 排污单位申请许可排放量的,应当一并提交排放量限值计算过程。重点污染物排放总量控制指标通过排污权交易获取的,还应当提交排污权交易指标的证明材料。
    Emission units applying for permission to emit, should be submitted together with the process of calculating emission limits. Key pollutant emission control indicators through emissions trading, should also be submitted to the emissions trading indicators of the supporting materials.
  • 污染物排放口已经建成的排污单位,应当提交有关排放口规范化的情况说明。
    For pollutant discharging units where pollutant discharge outlets have already been constructed, they shall submit a statement on the standardization of the discharge outlets.
  • 第十九条 排污单位在申请排污许可证时,应当按照自行监测技术指南,编制自行监测方案。
    Article 19: When applying for a pollutant discharge permit, the pollutant discharging unit shall compile a self-monitoring plan in accordance with the technical guidelines for self-monitoring.
  • 自行监测方案应当包括以下内容:
    A self-monitoring programme should include the following:
  • (一)监测点位及示意图、监测指标、监测频次;
    1. Monitoring points and schematic diagrams, monitoring indicators and monitoring frequency;
  • (二)使用的监测分析方法;
    (ii) Monitoring and analysis methods used;
  • (三)监测质量保证与质量控制要求;
    (iii) Monitoring quality assurance and quality control requirements;
  • (四)监测数据记录、整理、存档要求;
    4. Requirements for recording, sorting and archiving monitoring data;
  • (五)监测数据信息公开要求。
    (V) Requirements for the disclosure of monitoring data information.
  • 第二十条 审批部门收到排污单位提交的申请材料后,依照《条例》第九条、第十条要求作出处理。
    Article 20: After receiving the application materials submitted by the pollutant discharging unit, the approving authority shall handle the matter in accordance with the requirements of Articles 9 and 10 of the Regulations.
  • 审批部门可以组织技术机构对排污许可证申请材料进行技术评估,并承担相应费用。技术机构应当遵循科学、客观、公正的原则,提出技术评估意见,并对技术评估意见负责,不得向排污单位收取任何费用。
    The approving authority may organize technical institutions to conduct technical evaluations on the application materials for pollutant discharge permits and shall bear the corresponding costs. The technical institutions shall follow the principles of science, objectivity, and fairness, provide technical evaluation opinions, and be responsible for the technical evaluation opinions. They shall not charge any fees from the pollutant discharging units.
  • 技术机构开展技术评估应当遵守国家相关法律法规、标准规范,保守排污单位商业秘密。
    Technical institutions conducting technical evaluations shall comply with relevant national laws, regulations, standards, and norms, and keep the commercial secrets of pollutant discharging units confidential.
  • 第二十一条 排污单位采用相应污染防治可行技术的,或者新建、改建、扩建建设项目排污单位采用环境影响报告书(表)批准文件要求的污染防治技术的,审批部门可以认为排污单位采用的污染防治设施或者措施能够达到许可排放浓度要求。
    If the pollutant discharging unit adopts corresponding feasible pollution prevention and control technologies, or if the pollutant discharging unit for new, rebuilt, or expanded construction projects adopts pollution prevention and control technologies as required in the approved environmental impact report (or form), the approving authority may consider that the pollution prevention and control facilities or measures adopted by the pollutant discharging unit can meet the requirements for the permitted emission concentration.
  • 不符合前款规定情形的,排污单位可以通过提供监测数据证明其采用的污染防治设施可以达到许可排放浓度要求。监测数据应当通过使用符合国家有关环境监测、计量认证规定和技术规范的监测设备取得;对于国内首次采用的污染防治技术,应当提供工程试验数据予以证明。
    In cases that do not conform to the provisions of the preceding paragraph, the pollutant discharging unit may prove that the pollution prevention and control facilities adopted can meet the requirements for the permitted emission concentration by providing monitoring data. The monitoring data shall be obtained through the use of monitoring equipment that complies with relevant national environmental monitoring and metrological certification regulations and technical specifications. For pollution prevention and control technologies that are first adopted in China, engineering test data shall be provided as proof.
  • 第二十二条 对具备下列条件的排污单位,颁发排污许可证:
    Article 22 A pollutant discharge permit shall be issued to a pollutant discharge unit that meets the following conditions:
  • (一)依法取得建设项目环境影响报告书(表)批准文件,或者已经办理环境影响登记表备案手续;
    (1) Having legally obtained the approval document for the environmental impact report (or form) of the construction project, or having completed the registration procedures for the environmental impact registration form.
  • (二)污染物排放符合污染物排放标准要求,重点污染物排放符合排污许可证申请与核发技术规范、环境影响报告书(表)批准文件、重点污染物排放总量控制要求;其中,排污单位生产经营场所位于未达到国家环境质量标准的重点区域、流域的,还应当符合有关地方人民政府关于改善生态环境质量的特别要求;
    (2) The pollutant discharge meets the requirements of pollutant discharge standards, and the discharge of key pollutants meets the technical specifications for the application and issuance of pollutant discharge permits, the approval document for the environmental impact report (or form), and the requirements for total amount control of key pollutant emissions. Among them, if the production and operation site of the pollutant discharging unit is located in a key region or basin that has not met the national environmental quality standards, it shall also meet the special requirements of the relevant local people's government for improving the quality of the ecological environment.
  • (三)采用污染防治设施可以达到许可排放浓度要求或者符合污染防治可行技术;
    (3) The use of pollution prevention and control facilities can meet the requirements for the permitted emission concentration or comply with feasible pollution prevention and control technologies.
  • (四)自行监测方案的监测点位、指标、频次等符合国家自行监测规范。
    (4) The monitoring points, indicators, frequencies, etc. in the self-monitoring plan comply with the national self-monitoring specifications.
  • 第二十三条 审批部门应当在法定审批期限内作出审批决定,对符合条件的颁发排污许可证;对不符合条件的应当出具不予许可决定书,书面告知排污单位不予许可的理由,以及依法申请行政复议或者提起行政诉讼的权利。
    Article 23: The approving authority shall make a decision on approval within the statutory approval period, and issue a pollutant discharge permit to those who meet the conditions; for those who do not meet the conditions, a decision letter of disapproval shall be issued, informing the pollutant discharging unit in writing of the reasons for disapproval and their rights to apply for administrative reconsideration or file an administrative lawsuit in accordance with the law.
  • 依法需要听证、检验、检测、专家评审的,所需时间不计算在审批期限内,审批部门应当将所需时间书面告知排污单位。
    If hearings, inspections, testing, or expert evaluations are required by law, the time required for these processes shall not be counted as part of the approval period. The approving authority shall notify the pollutant discharging unit in writing of the time required for these processes.
  • 第二十四条 排污单位依照《条例》第十四条第二款规定提出延续排污许可证时,应当按照规定提交延续申请表。审批部门作出延续排污许可证决定的,延续后的排污许可证有效期自原排污许可证有效期届满的次日起计算。
    Article 24: When a pollutant discharging unit applies for a renewal of a pollutant discharge permit in accordance with the provisions of the second paragraph of Article 14 of the Regulation, it shall submit a renewal application form in accordance with the regulations. If the approving authority makes a decision to renew the pollutant discharge permit, the validity period of the renewed permit shall be calculated from the day following the expiration of the validity period of the original permit.
  • 排污单位未依照《条例》第十四条第二款规定提前六十日提交延续申请表,审批部门依法在原排污许可证有效期届满之后作出延续排污许可证决定的,延续后的排污许可证有效期自作出延续决定之日起计算;审批部门依法在原排污许可证有效期届满之前作出延续排污许可证决定的,延续后的排污许可证有效期自原排污许可证有效期届满的次日起计算。
    If a pollutant discharging unit fails to submit a renewal application form sixty days before the expiration of the validity period of the pollutant discharge permit as stipulated in the second paragraph of Article 14 of the Regulation, and the approving authority makes a decision to renew the permit after the expiration of the original permit in accordance with the law, the validity period of the renewed permit shall be calculated from the date of the renewal decision. If the approving authority makes a decision to renew the permit before the expiration of the original permit in accordance with the law, the validity period of the renewed permit shall be calculated from the day following the expiration of the validity period of the original permit.
  • 第二十五条 对符合《条例》第十五条规定的应当重新申请排污许可证情形的,排污单位应当在实际排污行为变化之前重新申请取得排污许可证。排污单位应当提交排污许可证申请表、由排污单位法定代表人或者主要负责人签字或者盖章的承诺书以及与重新申请排污许可证有关的其他材料,并说明重新申请原因。
    Article 25: In cases where a pollutant discharging unit needs to re-apply for a pollutant discharge permit in accordance with the provisions of Article 15 of the Regulation, the unit shall re-apply for and obtain a pollutant discharge permit before any changes in actual pollutant discharge activities occur. The pollutant discharging unit shall submit an application form for the pollutant discharge permit, a commitment letter signed or stamped by the legal representative or principal responsible person of the unit, and other materials related to the re-application for the pollutant discharge permit, and explain the reasons for the re-application.
  • 重新申请的排污许可证有效期自审批部门作出重新申请审批决定之日起计算。
    The validity period of the re-applied pollutant discharge permit shall be calculated from the date when the approving authority makes the decision on the re-application for approval.
  • 第二十六条 排污单位名称、住所、法定代表人或者主要负责人等排污许可证正本中记载的基本信息发生变更的,排污单位应当自变更之日起三十日内,向审批部门提交变更排污许可证申请表以及与变更排污许可证有关的其他材料。
    If there are changes to the basic information recorded in the original pollutant discharge permit, such as the name, address, legal representative, or principal responsible person of the pollutant discharging unit, the unit shall submit an application form for changing the pollutant discharge permit and other relevant materials related to the change to the approving authority within 30 days from the date of the change.
  • 审批部门应当自受理之日起十个工作日内作出变更决定,按规定换发排污许可证正本,相关变更内容载入排污许可证副本中的变更、延续记录。
    The approving authority shall make a decision on the change within ten working days from the date of acceptance, issue a new original pollutant discharge permit in accordance with the regulations, and record the relevant changes in the change and renewal record of the duplicate pollutant discharge permit.
  • 排污许可证记载信息的变更,不影响排污许可证的有效期。
    The changes in the information recorded in the pollutant discharge permit do not affect the validity period of the permit.
  • 第二十七条 排污单位适用的污染物排放标准、重点污染物排放总量控制要求发生变化,需要对排污许可证进行变更的,审批部门应当在标准生效之前和总量控制指标变化后依法对排污许可证相应事项进行变更。
    If there are changes in the pollutant discharge standards or total emission control requirements for key pollutants applicable to a pollutant discharging unit, and these changes require a modification to the pollutant discharge permit, the approving authority shall make the corresponding modifications to the permit in accordance with the law before the standards take effect and after the changes in the total emission control indicators.
  • 第二十八条 除本办法第二十五条、第二十六条、第二十七条规定情形外,排污许可证记载内容发生变化的,排污单位可以主动向审批部门提出调整排污许可证内容的申请,审批部门应当及时对排污许可证记载内容进行调整。
    Except for the situations stipulated in Articles 25, 26, and 27 of these Measures, if there are changes in the contents recorded in the pollutant discharge permit, the pollutant discharging unit may actively submit an application to the approving authority for adjusting the contents of the permit, and the approving authority shall promptly make adjustments to the contents recorded in the permit.
  • 第二十九条 有下列情形之一的,审批部门应当依法办理排污许可证的注销手续,并在全国排污许可证管理信息平台上公告:
    Article 29: In any of the following circumstances, the approving authority shall handle the cancellation procedures for the pollutant discharge permit in accordance with the law, and announce it on the national pollutant discharge permit management information platform:
  • (一)排污许可证有效期届满未延续的;
    (a) The validity period of the pollutant discharge permit has expired and has not been renewed;
  • (二)排污单位依法终止的;
    (ii) The pollutant discharging unit is terminated according to law;
  • (三)排污许可证依法被撤销、吊销的;
    (iii) The pollutant discharge permit is revoked or revoked according to law;
  • (四)应当注销的其他情形。
    (IV) Other circumstances that should be canceled.
  • 第三十条 有下列情形之一的,可以依法撤销排污许可证,并在全国排污许可证管理信息平台上公告:
    Article 30: In any of the following circumstances, the pollutant discharge permit may be revoked in accordance with the law, and the revocation shall be announced on the national pollutant discharge permit management information platform:
  • (一)超越法定职权审批排污许可证的;
    (a) Examining and approving pollutant discharge permits beyond statutory powers;
  • (二)违反法定程序审批排污许可证的;
    Examination and approval of pollutant discharge permits in violation of legal procedures;
  • (三)审批部门工作人员滥用职权、玩忽职守审批排污许可证的;
    (3) Staff of the approving authority abuse their power or neglect their duties in approving pollutant discharge permits;
  • (四)对不具备申请资格或者不符合法定条件的排污单位审批排污许可证的;
    (4) Approving pollutant discharge permits for pollutant discharging units that do not meet the eligibility requirements or do not comply with statutory conditions;
  • (五)依法可以撤销排污许可证的其他情形。
    5. Other circumstances under which the pollutant discharge permit can be revoked according to law.
  • 排污单位以欺骗、贿赂等不正当手段取得排污许可证的,应当依法予以撤销。
    If a pollutant discharging unit obtains a pollutant discharge permit through deception, bribery, or other improper means, the permit shall be revoked in accordance with the law.

  • 第四十四条 排污许可证正本、副本、承诺书样本和申请、延续、变更排污许可证申请表格式,由国务院生态环境主管部门制定。

  • 第四十六条 本办法自2024年7月1日起施行。原环境保护部发布的《排污许可管理办法(试行)》(环境保护部令第48号)同时废止。
