“航空案件审判站”成立 打造首个航空争议诉仲调一站式解决平台

《中国民航报》、中国民航网 记者钱擘、胡夕姮 通讯员李超、丁宁报道：5月18日，上海市长宁区人民法院（以下简称上海长宁法院）“航空案件审判站”正式成立并入驻虹桥临空经济园区，与航空争议调解中心、上海国际航空仲裁院一起，构建起国内首个航空争议一站式解决平台。上海市高级人民法院党组书记、院长贾宇，上海市长宁区委书记、区长张伟，共同为“航空案件审判站”揭牌。同时，华东政法大学与上海长宁法院联合举办“建设世界一流国际航运中心背景下的航空案件集约化、专业化审理研讨会”，旨在深化理论和实务界的共识，凝聚各方合力，打造航空法治高地。

At the same time, East China University of Political Science and Law and Shanghai Changning Court jointly held a seminar on "intensive and specialized trial of aviation cases in the context of building a world-class international shipping center", aiming to deepen the consensus between the theoretical and practical circles, and to build a highland of aviation rule of law by gathering the joint efforts of all parties.

上海作为国际航空枢纽，拥有浦东和虹桥两大机场，是全球第5个年航空客运量过亿人次的城市，以上海为主运营基地的航空公司多达7家。长宁区是上海虹桥国际机场所在区，也是众多国内外知名航空公司及其延伸产业公司的聚集区。早在1996年，上海长宁法院就曾受理首例国际航空货物运输赔偿纠纷案件。2015年，上海高院指定上海长宁法院集中管辖全市涉飞行员劳动争议案件，受理案件数量呈现井喷状态。2020年，其与中航协共同成立了全国首个航空争议调解中心，为创新航空领域多元纠纷化解机制奠定了坚实的基础。

中国民用航空局政策法规司副司长杨颖表示，“航空案件审判站”的成立恰逢其时。她期待长宁法院能通过一个个案件的审理，带动一系列问题的解决，助力行业发展。其也期待这种司法示范效应能够从上海辐射到整个华东地区，从华东地区辐射到全国，在更高层面、更大范围内营造法院与民航业互促互进的良好氛围。

Yang Ying, deputy director of the Department of Policies and Regulations of the Civil Aviation Administration of China (CAAC), said that the establishment of the "Aviation Trial Station" was timely. She expects that the Changning Court can drive a series of problems to be solved through the trial of one case and help the development of the industry. She also expects that this judicial demonstration effect can be radiated from Shanghai to the whole East China region and from East China to the whole country, creating a good atmosphere of mutual promotion and progress between the court and the civil aviation industry at a higher level and in a larger scope.

成立仪式现场，上海长宁法院党组书记、院长孙培江致辞并为“航空争议一站式解纷专家智库”首批专家颁发聘书。上海长宁法院、上海国际经济贸易仲裁委员会（上海国际仲裁中心）、上海市法学会航空法研究会、华东政法大学、中国航空运输协会共同签署《关于共同构建航空争议一站式多元解纷机制的合作备忘录》，探索形成集司法引导、诉调对接、裁审联动、行业协同于一体的航空争议多元化解机制和航空法治建设合作交流平台，高效、便利、稳妥地化解航空领域矛盾纠纷。

在随后举行的研讨会上，八位来自航空法理论界和实务界的专家学者分别从航空争议的专业化解决、航空仲裁与诉讼的对接、航空法治人才的培养等维度进行交流与发言。来自法院系统、法律行业、民航业、高校和科研机构的代表共计150余人出席了此次会议。

In the seminar held afterwards, eight experts and scholars from the theoretical and practical circles of aviation law exchanged and spoke from the dimensions of professional settlement of aviation disputes, the docking of aviation arbitration and litigation, and the cultivation of aviation rule of law talents. A total of more than 150 representatives from the court system, legal industry, civil aviation industry, universities and research institutions attended the conference.

据悉，目前航空争议案件的审理范围主要包括：（一）航空货物、航空旅客运输合同纠纷；（二）航空器所有权、航空器抵押权、航空器留置权、航空器优先权等物权纠纷；（三）航空器、航空器附属设备等制造、买卖合同纠纷；（四）航空货运、航空广告、航空票务等代理合同纠纷；（五）航空票务等网络服务合同纠纷；（六）航空器租赁合同纠纷、航空器融资租赁合同纠纷及航空保险合同纠纷；（七）在航空运输过程中发生的侵害生命权、身体权、健康权等侵犯人身权纠纷、及在航空服务过程中涉消费者个人信息保护纠纷；（八）飞行员、空乘、地勤、航空维修工等与航空运输服务相关人员的劳动争议纠纷；（九）本辖区范围内与机场运营管理相关的买卖合同纠纷、服务合同纠纷、房屋租赁合同纠纷等民商事纠纷；（十）其他与航空运输、航空安全相关的民商事纠纷。（编辑：王亚玲 校对：金杰妮 审核：程凌）
